Selling an inherited Pennsylvania property from out of state

You probably inherited a house you didn't expect and didn't visit often. The estate attorney has been moving through Pennsylvania probate slowly, and you live in a different state. There's furniture and belongings inside that you don't know what to do with. Property tax bills are still coming. You may have a sibling co-heir who doesn't agree with you on what to do. None of this is unusual — Pennsylvania probate is genuinely slow, and the rules around taxes are not intuitive.

You don't have to wait for probate to fully close

Pennsylvania probate runs through the Register of Wills in each county and typically takes 6 to 12 months to fully close. But you don't have to wait that long to sell. The executor or administrator can sell the property mid-probate with appropriate court approval (Petition to Sell Real Estate) and the proceeds go into the estate account for later distribution. We coordinate directly with your estate attorney on this — there's nothing unusual about it.

Understand the tax math before you decide

Two tax facts matter. First, Pennsylvania inheritance tax applies before the estate closes: 0% for surviving spouses, 4.5% for lineal descendants (children, grandchildren), 12% for siblings, 15% for other beneficiaries. Second, if the property qualified as the decedent's primary residence (Section 121 of the IRS code) the heirs may exclude up to $250,000 of capital gain. Talk to a CPA before deciding on a sale price — these two numbers materially change what you walk away with.

On the belongings and condition
